Right of Withdrawal
A right of withdrawal for consumers does not exist in the following contracts:
Contracts for the provision of services in the area of accommodation for purposes other than residential purposes, the transportation of goods, vehicle rental, the supply of food and beverages, and the provision of further services related to leisure activities, if the contract provides for the provision of services on a specific date or during a specific period (§ 312 g para. 2 sentence 1 no. 9 BGB). This means that, as far as DAYAWAY offers services in the area of leisure activities, as in this case, there is no right of withdrawal. The order is therefore binding immediately after confirmation by DAYAWAY pursuant to section 3 and obliges the customer to accept and pay for the goods.
For other contracts with consumers, the following applies:
Withdrawal Instructions / Right of Withdrawal
You have the right to withdraw from this contract within 14 days without providing any reason. Your right of withdrawal lasts 14 days from the day you or a third party designated by you, who is not the carrier, takes possession of the goods. To exercise your right of withdrawal, you must inform us, DAYAWAY, Bohnenbergerring 17, 75305 Neuenbürg, Tel:, Fax:, E-Mail, by means of a clear statement (e.g., by mail, letter, fax, or e-mail) about your decision to withdraw from this contract. You may use the attached withdrawal form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal:
If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (except for additional costs arising if you have chosen a different type of delivery than the cheapest standard delivery we offer), without undue delay and no later than 14 days from the day we receive the notification of your withdrawal from this contract. We will use the same payment method for this refund that you used in the original transaction unless expressly agreed otherwise with you. In no case will you be charged any fees for this refund. We may withhold the refund until we have received the goods back or you have provided evidence that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any event no later than 14 days from the day you inform us about the withdrawal from this contract. The deadline is met if you send the goods before the period of 14 days has expired. You will bear the direct costs of returning the goods. You are only liable for any diminished value of the goods if the diminished value is due to handling of the goods that was not necessary to check their condition, properties, and functioning.

In the event of withdrawal by the customer, the following applies: DAYAWAY may refuse the refund until the goods have been returned or until the customer has provided proof that the goods have been returned, whichever is earlier.
The customer must return or send the goods back to DAYAWAY without delay and in any case no later than 14 days from the day on which the customer informs DAYAWAY about the withdrawal from the contract. The deadline is met if the customer sends the goods before the 14-day period has expired. The customer bears the direct costs of returning the goods. The customer is liable for any loss in value of the goods if this loss in value is due to handling the goods beyond what is necessary to establish their nature, characteristics, and functionality.
